Sikap dan Argumentasi Hukum Partai Keadilan Sejahtera (PKS) terhadap Kepala Daerah Nonmuslim

Abstract: Prosperous Justice Party (PKS/Partai Keadilan Sejahtera) is an Islamic-based political party and adheres to a formalist Islamic view. As a party complying with Islamic ideology, PKS has always refused non-Muslim national leadership to occupy the position of President. However, in several Regional Elections (Pilkada), PKS supported non-Muslim Regional Head candidates. This paper examines PKS’s legal standing and attitudes towards the election of non-Muslim regional heads. This is a field research that uses interpretation and political approaches. Data were collected by way of in-depth interviews at the DKI Jakarta Central Executive Board (DPP) and the Surakarta (Solo) Regional Executive Board (DPW). The data were analyzed qualitatively inductively. The results showed that the proposals for non-Muslim regional heads or vice of regional heads in the Regional Elections were an ijtihadi problem that had its own dynamics and characteristics. This dynamic is in line with the political realities in the regions, the personality of the promoted candidates, and the prospects for party electability. In its fiqh considerations, PKS is of the view that the regional heads shall not be deemed as a very strategic position, like the head of state. In contrast to the position of the head of state, which in the view of the PKS must be held by a Muslim, the leadership of the regional head may and could be submitted to non-Muslims. However, this permission is not absolute, since there are certain prerequisites that apply for non-Muslim regional head candidates before PKS can accept them.
Abstrak: Paratai Keadilan Sejahtera (PKS) merupakan partai berideologi Islam dan menganut pandangan Islam formalis. Sebagai partai berideologi Islam, PKS selalu menolak kepemimpinan nonmuslim untuk menduduki jabatan sebagai Presiden. Akan tetapi dalam beberapa Pilkada, PKS justru mendukung calon Kepala Daerah nonmuslim. Tulisan ini mengkaji sikap dan argumentasi hukum PKS terhadap pemilihan Kepala Daerah nonmuslim. Penelitian ini merupakan penelitian lapangan (field research) yang menggunakan pendekatan interpretasi dan politik. Pengumpulan data dilakukan dengan wawancara secara mendalam pada Dewan Pengurus Pusat (DPP) DKI Jakarta dan Dewan Pengurus Wilayah (DPW) Surakarta (Solo). Analisis dilakukan secara induktif kualitatif. Hasil penelitian menunjukkan bahwa usungan calon Kepala Daerah atau Wakil Kepala Daerah nonmuslim dalam Pilkada merupakan permasalahan ijtihadi yang memiliki dinamika dan karakteristik tersendiri. Dinamika itu selaras dengan realitas politik di daerah, personal yang diusung, dan prospek elektabilitas partai. Dalam pertimbangan fikihnya, PKS berpandangan bahwa Pilkada tidak termasuk dalam wilayah yang sangat strategis, seperti halnya kepala negara. Berbeda dengan kedudukan kepala negara yang dalam pandangan PKS harus dijabat oleh seorang muslim, kepemimpinan kepala daerah boleh dan memungkinkan untuk diserahkan kepada nonmuslim. Akan tetapi kebolehan tersebut tidak bersifat mutlak. Ada prasyarat-prasyarat tertentu yang harus dipenuhi bagi calon kepala daerah nonmuslim yang bisa diterima oleh PKS.
