Abstract

sejatinya agama adalah pencarian spiritual manusia tentang hakekat kebenaran dan kedamaian dirinya dengan Tuhan yang terjadi secara evolutif. Dalam proses pencarian dan kebenaran itu maka beragama dipandang sebagai salah satu hak asasi manusia (HAM) yang harus dihormati oleh institusi apa dan manapun. Karena itu dalam konfigurasi ketatanegaraan, HAM beragama mempunyai posisi yang sangat penting. Bagaimanapun juga HAM beragama akan menemukan jantung “persoalan” yang utama ketika berhadapan dengan entitas negara. Persoalan yang munculkemudian bagaimana posisi agama dalam konteks negara? Atau posisi agama dalam konteks hukum? Tulisan ini ingin mengkaji lebih mendasar bagaimana HAM Beragama dalam perspektif Filsafat Ilmu Hukum.
